Zoning & Conditions
Municipal zoning regulates lodging-type short-term lodging: Berryville defines 'Bed & Breakfast Facility' as a limited commercial activity with the operator living on the premises or adjacent premises and lists hotels/bed & breakfasts among permitted uses in certain commercial/residential-office districts; conditional use permits are required where zoning lists conditional uses. Eureka Springs Ordinance No. 2364 prohibits bed & breakfasts in R-1, R-2 and R-3 residential zones and requires owner-occupancy on transfer of certain LNC/CUP properties.
How to Obtain a Permit
1) Submit conditional-use/rezoning application to the Mayor’s Office/Building Official, including required documentation and filing fee per the city fee schedule; 2) Application is reviewed by Planning Commission with a public hearing (notice published and mailed to adjacent owners) and then forwarded to City Council for approval; 3) If approved, comply with any conditions, obtain required business license/certificate of occupancy as required by the municipality.
