Zoning & Conditions
Village code does not use the term 'short-term rental' but regulates Bed & Breakfasts and changes of use: B&Bs require a Special Use Permit in all districts; owner must live in the residence; guest sleeping limited to the first two stories; maximum 4 bedrooms for overnight accommodations (one reserved for owner) (max 5 bedrooms total); B&Bs must comply with NYS Uniform Fire Prevention & Building Code and NYS Sanitary Code and are inspected every 3 years. Change of use/site plan rules, parking, occupancy posting, and Certificate of Occupancy requirements apply.
How to Obtain a Permit
1) File a written Special Use Permit/site-plan application with the Village of Rushville Code Enforcement Officer on the required form and submit required materials (deed, site plan prepared by licensed professional, EAF when required, parking info). 2) Application is referred to the Planning Board; a public hearing/neighbor notification (certified mail to owners within 500 ft; applicant pays) is held and the Planning Board issues approval/conditions within 62 days. 3) Upon Planning Board approval the Code Enforcement Officer issues the permit; obtain Certificate of Occupancy/Certificate of Compliance from the CEO within 10 days after change of use is completed; fees are set by Village Board resolution; Special Use Permits expire after one year unless work initiated.
